Alimony – Property Division – Complex and Substantial Asset division

Property Division
The division of property is a difficult and divisive aspect of divorce. Our skilled Colorado divorce lawyers at DeJong & Associates, LLC, are very knowledgeable about property division. We know how to find hidden assets and ensure that marital property is fairly divided. We have had experience with the complexities of substantial asset division. To contact an attorney about property division, call DeJong & Associates, LLC.

Marital property includes debts or assets acquired during a marriage. This also includes the increase in value of property acquired before the marriage. When establishing property settlements between divorcing parties and ensuring that the property is evenly divided, our legal practice uses techniques such as:

  • Business Evaluations
  • Accountant Investigations
  • Document Research (Bank Records, Business records)
  • Private Detective Report Review
  • Discovery of Evidence
  • Valuation of Pension
  • Dividing pensions using a QDRO (Qualified Domestic Relations Order)
  • Identifying Non-cash Assets

Spousal Maintenance
The issue of spousal maintenance, or alimony, arises in about 25% of our divorce cases. Temporary maintenance is calculated based on a presumptive formula using the incomes of the two parties. Temporary spousal maintenance gives the lower income spouse support during the pending divorce action.

Long-term maintenance may be awarded when one party lacks sufficient property or is unable to be self-supporting through employment. The kinds of issues that the court considers in awarding long-term maintenance include:

  • Previous standard of living
  • Age of parties
  • Length of marriage
  • Physical and emotional condition of parties
  • Other party’s ability to pay
    support
  • Results of property division
  • Non-tangible value
    contributed to marriage
    (support during
    professional education,
    frequent travel as the
    result of spouse’s work, etc.)
  • Tax implications of alimony
    payments

The award of long-term maintenance is highly subjective, varying among counties and judges. Our Frisco and Denver maintenance attorneys are familiar with the judges and courts involved in maintenance / alimony orders, and advise clients on the probable outcome of their support request.
